There was a data breach at Guardian Life Insurance Company of America (Guardian), an American life insurance company. Some customers of one of its companies, Webster Bank, had their personal information stolen in the breach.

Someone got into the private information of some Webster Bank users because of a flaw in the security system. This led to the data incident.

That was January 24, 2023, when the company learnt about it. It wasn’t until February 10, 2023, that the Guardian revealed that Webster Bank’s data had been affected. Customers’ names, Social Security numbers, and account numbers were among the data that was stolen.

What is the Webster Bank Settlement?

The defendants have agreed to pay more than $1.4 million to end the cases, which were merged with other lawsuits with similar claims in July 2023. The settlement agreement says that the people who are protected will be told about the deal no later than January 24, which is 21 days after the court gives its initial approval.

People in the class who file a claim and show proof that the breach caused them to pay for certain costs out of pocket can get up to $200 in reimbursement. People who are covered by the deal can also file a claim and get $25 for every hour they can prove they spent dealing with the event, up to a maximum of four hours.

In addition, people in the class who have been victims of scams or identity theft can get up to $5,000. People who are eligible can also file a claim for two years of free tracking of their credit and identity theft by three bureaus, with $1 million in insurance. The last meeting for approval is set for May 20, 2024.

Who is Eligible?

The settlement includes everyone who was told that their personal information may have been compromised during the data security breach that happened on Guardian’s servers from November 27, 2022, to January 22, 2023.

Who is Representing the Plaintiffs?

Mark S. Holden, Richard Andisio, Edward Marshall, Ann Marie Marshall, Arthur Christiani, Johnielle Dwyer, Pawel Krzykowski, Mariola Krzynowek, James Howe, and Cindy A. Pereira are the ten claimants who speak for the case. They look out for the interests of everyone in the class who has had similar problems.

Final Approval

One last hearing for approval will take place on May 20, 2024. The Court will decide if the Settlement is acceptable. If it is, it will also decide how much the plaintiffs’ service will cost and how much the Class Counsel will get paid.
